General Terms and Conditions of Sale and Use 

KAREidoscope 

Version of 1 January 2026 – These terms supersede and replace any previous version. 

This document is a translation. In the event of any discrepancy, the French version prevails. 

1. Provider details

These general terms and conditions (hereinafter the “GTC“) govern the relationship between:

(hereinafter “KAREidoscope“, “we” or “the Provider“) 

and any natural or legal person using the services, purchasing products or accessing the website (hereinafter “the Client” or “the User“).

2. Scope

2.1 These GTC apply to all services provided, all product sales and all use of the website www.kareidoscope.ch. 

2.2 Booking an appointment, placing an order, attending a session or using the website constitutes full and unreserved acceptance of these GTC. 

2.3 Any conflicting terms issued by the Client, in particular the Client’s own purchasing conditions, are binding on KAREidoscope only if expressly accepted in writing. 

2.4 KAREidoscope reserves the right to amend these GTC at any time. The applicable version is the one in force and published on the website at the time the contract is concluded. 

2.5 In the event of any discrepancy between the French version and a translation, the French version prevails.

3. Nature of the services — essential clause

3.1 KAREidoscope offers services in the field of complementary and wellbeing approaches, namely: 

  • brain training through NeurOptimal® dynamical neurofeedback; 
  • chromotherapy and colour assessment; 
  • consultancy in the design of Espaces vivants (healthy, ecological and colour-conscious living environments); 
  • the sale of wellbeing devices and accessories. 


3.2 
These services do not, under any circumstances, constitute a medical act, a diagnosis, a medical treatment, psychotherapy or a prescription. They are not a substitute for medical consultation, nor for any ongoing or necessary medical, psychiatric or psychological treatment. 

3.3 The Provider is not a physician. She makes no diagnosis and does not prescribe, modify or discontinue any treatment or medication. The Client undertakes never to discontinue, modify or suspend an ongoing medical treatment without first consulting their treating physician. 

3.4 NeurOptimal® neurofeedback sessions consist of training the central nervous system by means of a non-linear, non-invasive system. The system neither diagnoses nor treats any condition; it does not steer the brain towards a predetermined state. 

3.5 KAREidoscope is bound by a best-efforts obligation, not an obligation to achieve a specific result. The effects of sessions vary from one individual to another according to personal factors and can be neither guaranteed, quantified nor predicted. No outcome, improvement or timeframe is promised or warranted. 

3.6 Testimonials, articles, studies and content published on the website are provided for information purposes only and constitute neither a promise of results nor a therapeutic claim. 

3.7 In the event of an emergency, psychological distress or concerning symptoms, the Client must contact their physician, the emergency services (144) or an appropriate helpline.

4. Client’s obligations and responsibility

4.1 Before the first session, the Client undertakes to disclose all relevant information regarding their state of health, in particular: current treatments, medical or psychiatric history, pregnancy, epilepsy or history of seizures, implanted medical devices (pacemaker, stimulator, cochlear implant, etc.), skin or eye conditions, photosensitivity, and the use of photosensitising medication. 

4.2 The Client remains solely responsible for the accuracy and completeness of the information provided. KAREidoscope accepts no liability arising from incomplete, inaccurate or belated information. 

4.3 The Client retains full responsibility for their health-related decisions and medical follow-up. 

4.4 Minors and persons under guardianship: any service provided to a minor or to a person subject to a protective measure requires the prior express consent of the legal representative(s) and their attendance at the first session. The signing legal representative is liable for payment of the services. Where parental authority is held jointly, the consenting representative is deemed to act with the agreement of the other parent. 

4.5 The Client undertakes to behave respectfully. KAREidoscope reserves the right to interrupt a session and terminate the contractual relationship, without refund, in the event of inappropriate, threatening or discriminatory behaviour, or of manifest intoxication. 

4.6 Recording, filming or photographing a session without the Provider’s prior written consent is prohibited.

5. Booking and conclusion of the contract

5.1 Appointments may be booked by telephone, e-mail or through the online booking system. The contract is deemed concluded upon confirmation of the appointment by KAREidoscope. 

5.2 The Client is asked to arrive at the agreed time. Any lateness is deducted from the session, which ends at the originally scheduled time and is invoiced in full. 

5.3 KAREidoscope reserves the right to decline a request for services without stating reasons, in particular where the request falls outside her field of competence. 

5.4 The Client may terminate the support at any time, without notice or justification, subject to payment for services already rendered.

6. Cancellation and rescheduling

6.1 Any cancellation or rescheduling must be notified at least 24 hours in advance (48 hours for home visits, workplace visits and Espaces vivants services), by telephone, SMS or e-mail. 

6.2 In the event of late cancellation or non-attendance (“no-show”), the session is payable in full and invoiced at the standard rate. Such charges are not reimbursed by insurers. 

6.3 Duly substantiated cases of force majeure (acute illness supported by a medical certificate, accident, bereavement) are excepted and assessed in good faith. 

6.4 KAREidoscope reserves the right to cancel or reschedule an appointment for compelling reasons (illness, unavailability, force majeure). In such cases the session is rescheduled by mutual agreement or, failing that, refunded. No further compensation is due. 

7. Home and workplace services

7.1 KAREidoscope offers services at the Client’s home or workplace, in particular for persons with reduced mobility. 

7.2 Such services are subject to a travel surcharge, communicated in advance and calculated according to the distance from Le Mont-sur-Lausanne. 

7.3 The Client undertakes to provide a quiet, clean, safe and adequately lit space with access to mains electricity, and warrants that the premises are free of hazards (uncontrolled animals, defective installations, etc.). 

7.4 If on-site conditions do not allow the service to be delivered properly, it may be cancelled on the spot and remains payable, including travel costs. 

7.5 The Client is liable for damage caused to KAREidoscope’s equipment during the visit, except for normal wear and tear or fault attributable to the Provider. 

8. Prices and payment

8.1 The applicable rates are those displayed on the website or communicated in writing at the time of booking. All prices are in Swiss francs (CHF). The Provider is not registered for value added tax; no VAT is charged and the prices shown are net prices. 

8.2 The payment methods currently accepted are cash and bank transfer. Services delivered at the practice, at the Client’s home or at the workplace are payable at the end of each session in cash, or by invoice settled by bank transfer within 10 days of the invoice date. KAREidoscope reserves the right to introduce further payment methods at a later date. 

8.3 In the event of late payment, the Client is in default as from the due date without further reminder. KAREidoscope is entitled to charge default interest of 5 % per annum (art. 104 Swiss Code of Obligations, “CO”) and a reminder fee of CHF 20.– from the second reminder onwards. Collection and debt-enforcement costs are borne by the Client. 

8.4 KAREidoscope reserves the right to suspend all services where an invoice remains unpaid. 

8.5 Rates may be amended at any time; services already booked remain invoiced at the agreed rate. 

8.6 Any dispute regarding an invoice must be raised in writing within 30 days of receipt. 

9. Packages and session cards

9.1 Packages and session cards are personal and non-transferable, unless otherwise agreed in writing. 

9.2 They are payable in full in advance and are non-refundable, save in duly established cases of force majeure (relocation to a distant area, lasting medical incapacity supported by a certificate). Upon substantiated request, an unused balance may be converted into a credit note valid for 12 months. 

9.3 The period of validity is 12 months from the date of purchase. Sessions not used within that period lapse without compensation. 

9.4 Gift vouchers are subject to the same rules and may be transferred to a third party unless otherwise stated. 

10. Supplementary insurance and ASCA

10.1 KAREidoscope holds ASCA accreditation for the relevant services. 

10.2 Any reimbursement of sessions is a matter solely between the Client and their supplementary health insurer under their individual policy. KAREidoscope gives no guarantee whatsoever that services will be covered, in whole or in part. 

10.3 It is the Client’s responsibility to verify the extent of their cover with their insurer before the first session. Services remain payable to KAREidoscope irrespective of any decision by the insurer. 

10.4 Purely wellbeing-related sessions, travel surcharges, late cancellations and products sold are not reimbursable by insurers. 

10.5 Invoices are issued in the Client’s name and are submitted by the Client to their insurer. KAREidoscope does not offer direct billing to insurers. 

11. “Espaces vivants” service (interior design consultancy)

11.1 Interior design consultancy services are subject to a prior written quotation setting out the scope of work, the schedule and the price (fixed fee or hourly rate). The contract is concluded upon written acceptance of the quotation. 

11.2 A deposit of 30 % is payable on order. The balance is due upon delivery of the agreed outputs. 

11.3 Timeframes given are estimates. They are suspended for as long as the Client has not supplied the necessary information, access or approvals. 

11.4 Any work exceeding the agreed scope is subject to a written addendum. 

11.5 The concepts, plans, sketches, colour palettes and documents delivered remain the intellectual property of KAREidoscope until payment has been received in full. The Client is thereafter granted a personal, non-exclusive right of use, excluding any assignment, resale or reuse for the benefit of a third party. 

11.6 KAREidoscope acts in an advisory capacity. She assumes neither the management of the works nor responsibility for their execution by third parties (tradespeople, contractors, suppliers), nor for the compliance of the works with building standards, nor for obtaining administrative permits. 

11.7 In the event of termination by the Client, work already carried out and costs already incurred remain payable. 

11.8 Unless the Client objects in writing, KAREidoscope may photograph completed projects and use the images as professional references, without disclosing the Client’s name or address.

12. Sale of products

12.1 Orders. Orders may be placed via the website, by e-mail or at the practice. The contract is concluded upon confirmation of the order by KAREidoscope. Offers are valid while stocks last. In the event of an obvious pricing error or unavailability, KAREidoscope may cancel the order and refund the Client in full, to the exclusion of any further compensation. 

12.2 Prices and payment. Prices are stated in CHF, excluding delivery costs and without VAT. Unless otherwise agreed, products ordered remotely are payable in advance by bank transfer, the order being processed only once payment has been received. Products collected at the practice may be paid for in cash. 

12.3 Delivery. Deliveries are made within Switzerland and Liechtenstein. Delivery times are indicative and not binding on KAREidoscope; a delay gives rise to neither cancellation nor compensation. Risk passes to the Client upon handover of the product to the carrier. 

12.4 Retention of title. Products remain the property of KAREidoscope until the price has been paid in full (art. 715 Swiss Civil Code). 

12.5 Inspection and notice of defects. The Client must inspect the products on receipt and report any defect or transport damage in writing within 7 days. Failing this, the product is deemed accepted (art. 201 CO). 

12.6 Warranty. Products carry the statutory warranty for defects, limited to 24 months from delivery, together with any manufacturer’s warranty. The warranty is limited, at KAREidoscope’s option, to repair or replacement of the product; price reduction and rescission of the contract are excluded to the extent permitted by law. The warranty does not apply in cases of normal wear and tear, damage resulting from use contrary to the instructions, lack of maintenance, use of non-approved consumables or parts, intervention by an unauthorised third party, or use for purposes other than those intended. 

12.7 No right of return. Swiss law provides no right of withdrawal or cancellation for purchases made online, by mail order or at the practice. Products ordered are not taken back, exchanged or refunded, subject to the statutory warranty for defects (art. 12.6) and to the right of revocation set out in art. 12.8. Clients are invited to inform themselves about a product’s characteristics before ordering; KAREidoscope is available for advice beforehand. 

12.8 Contracts concluded at the Client’s premises. Where an order is concluded at the Client’s home or workplace and exceeds CHF 100.–, the Client has a 14-day right of revocation pursuant to art. 40a et seq. CO. Revocation must be notified in writing within that period. 

12.9 Use of devices. The devices sold (water purifier, filtering shower head, ionic detoxification device, cold laser, chromotherapy lamp, etc.) are intended for wellbeing and comfort use. They are not medical devices and are not intended to diagnose, treat or cure any disease. The Client undertakes to comply strictly with the manufacturer’s instructions, safety guidance and contraindications — in particular eye protection for light-emitting and laser devices, and contraindications relating to pregnancy, epilepsy, photosensitivity, implanted devices or cardiac conditions. Devices must be kept out of the reach of children. KAREidoscope accepts no liability in the event of improper use. 

12.10 Resale. Products are sold for the Client’s own use. Any commercial resale requires KAREidoscope’s prior written consent. 

13. Limitation of liability

13.1 KAREidoscope’s liability is limited to damage caused by gross negligence or wilful misconduct, within the limits of art. 100 para. 1 CO. 

13.2 To the fullest extent permitted by law, liability is excluded for indirect and consequential damage, in particular loss of profit, loss of data, business interruption, non-material damage, or loss arising from decisions taken by the Client on the basis of the services provided. 

13.3 KAREidoscope accepts no liability for: 

  • the consequences of inaccurate, incomplete or belated information provided by the Client; 
  • the Client’s discontinuation, modification or refusal of a medical treatment; 
  • improper use of the devices sold or of the recommendations given; 
  • personal belongings lost, forgotten or damaged on the premises; 
  • the acts or omissions of third parties (carriers, tradespeople, suppliers, hosting provider, booking platform). 

13.4 In any event, and save in cases of gross negligence or wilful misconduct, KAREidoscope’s total liability is limited to the amount actually paid by the Client for the service or product concerned. 

13.5 KAREidoscope holds professional liability insurance covering her activity as a complementary and wellbeing therapist, taken out with Zurich Insurance Company Ltd, with a sum insured of CHF 5,000,000 per claim and a contractual deductible. Cover extends in particular to product liability, to the use of radiation-emitting devices (laser and other rays) and to breaches of data protection legislation. 

13.6 Compensation for any damage is provided primarily through this insurance. Any claim must be notified to KAREidoscope in writing and without delay upon discovery of the damage, together with the evidence supporting it, so that the claim can be reported to the insurer within the required time limits. The Client shall refrain from any admission of liability or settlement with a third party without the prior agreement of KAREidoscope and her insurer. 

14. Force majeure

14.1 KAREidoscope is not liable for non-performance or delayed performance resulting from force majeure, meaning any unforeseeable and insurmountable event beyond her control: natural disaster, epidemic, pandemic, decisions of the authorities, strike action, prolonged failure of electricity, internet or telecommunications, fire, accident, or serious illness of the Provider. 

14.2 In such cases, obligations are suspended for the duration of the impediment. The services concerned are rescheduled or, where rescheduling is impossible, refunded on a pro rata basis, to the exclusion of any further compensation. 

15. Confidentiality and data protection

15.1 KAREidoscope treats all information communicated by the Client as strictly confidential. This obligation survives the end of the contractual relationship. 

15.2 Personal data is processed in accordance with the Swiss Federal Act on Data Protection (revFADP) and, where applicable, the GDPR. It is collected solely for the purposes of performing the contract, invoicing, managing the client relationship, operating the website and complying with legal obligations. 

15.3 Health data constitutes sensitive personal data within the meaning of art. 5 revFADP and benefits from enhanced protection. It is processed only with the Client’s consent and is never used for marketing purposes. 

15.4 No data is disclosed to third parties without the Client’s express consent, subject to any legal or judicial obligation. The following act as technical processors, bound by confidentiality: the hosting provider Infomaniak Network SA (Switzerland), the online booking platform, payment service providers, and — subject to the User’s consent — Google (Google Tag Manager and Google Analytics), whose use entails a transfer of browsing data to the United States. 

15.5 Client records are retained for as long as necessary for follow-up and to meet legal obligations — in particular the 10-year accounting retention period for invoicing records — and are then securely destroyed. 

15.6 The Client has the right to access, rectify, erase, restrict, object to and port their data, exercisable at: info@kareidoscope.ch. 

15.7 For details of processing activities, cookies and analytics tools used, please refer to the Privacy Policy published on the website, which forms an integral part of these GTC. 

16. Use of the website and intellectual property

16.1 All website content (text, photographs, logo, the KAREidoscope trade name, illustrations, layouts, blog articles) is protected by copyright and remains the exclusive property of KAREidoscope or its licensors. 

16.2 Any reproduction, distribution, modification or exploitation, in whole or in part, without prior written authorisation is prohibited. 

16.3 NeurOptimal® is a registered trademark of Zengar Institute Inc., used within the framework of the Provider’s certification. All other trademarks mentioned remain the property of their respective owners. 

16.4 Information published on the website is provided for general information purposes, without warranty of completeness or currency. It does not replace individual medical or professional advice. 

16.5 KAREidoscope accepts no responsibility for the content of third-party sites accessible via hyperlinks, nor for uninterrupted availability of the website. 

16.6 It is prohibited to use the website for unlawful purposes, to disrupt its operation, or to extract its content on a large scale by automated means. 

17. Reviews and testimonials

17.1 Testimonials are published with the written consent of the persons concerned. They reflect individual experiences and are no indication of the effects that others may experience. 

17.2 A Client who has authorised the publication of a testimonial may request its removal at any time, without stating reasons. 

18. Severability

Should any provision of these GTC be held void, invalid or unenforceable, the validity of the remaining provisions shall not be affected. The provision concerned shall be replaced by a valid clause reflecting as closely as possible the parties’ original economic intent. 

19. Governing law and jurisdiction

19.1 These GTC and any contractual relationship with KAREidoscope are governed exclusively by Swiss law, to the exclusion of its conflict-of-law rules and of the United Nations Convention on Contracts for the International Sale of Goods (CISG). 

19.2 The exclusive place of jurisdiction is Lausanne (Canton of Vaud), Switzerland, subject to any mandatory places of jurisdiction provided by law, in particular art. 32 of the Swiss Civil Procedure Code in favour of consumers. 

19.3 In the event of a dispute, the parties shall endeavour to reach an amicable settlement before initiating legal proceedings.
